Agreement to Terms
These Terms of Service ("Terms") govern your use of the SugarSpoon mobile application ("App") operated by Melvin P Mathew ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Description of Service
SugarSpoon is a mobile application that allows users to scan food nutrition labels using their device camera and receive information about sugar content displayed in tablespoons. The App uses artificial intelligence to analyze images and extract nutritional data.
Eligibility
You must be at least 13 years of age to use the App. By using SugarSpoon, you represent that you meet this age requirement. If you are under 18, you should use the App with the involvement of a parent or guardian.
Free and Pro Tiers
Free Tier: SugarSpoon offers a free tier that includes up to 3 scans per day, basic sugar content results (grams and tablespoons), glass visualization, and product name detection.
Pro Tier: SugarSpoon Pro is available as a paid subscription that unlocks unlimited scans, full scan history with images, daily sugar tracker, serving breakdown with calories, and food comparisons. Pro is available at $1.99 per week or $24.99 per year.
Free Trial: We may offer a 3-day free trial of SugarSpoon Pro. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription at the applicable rate.
Subscriptions and Payments
All subscriptions are processed through Apple's App Store or Google Play, depending on your device. By subscribing, you agree to the payment terms presented at the time of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription through your device's App Store or Google Play settings.
- Refunds are handled according to the policies of Apple or Google, as applicable.
- Prices may change with reasonable notice. Continued use after a price change constitutes acceptance.
Acceptable Use
You agree to use SugarSpoon only for its intended purpose of scanning food labels and tracking sugar content. You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's servers or services
- Submit images that contain inappropriate, illegal, or harmful content
- Use automated tools to make excessive scan requests
- Resell, redistribute, or sublicense access to the App
Accuracy Disclaimer
SugarSpoon is an informational tool and is not a substitute for professional nutritional or medical advice. While we strive for accuracy, the AI-powered scanning feature may not always correctly identify sugar content. Results may vary based on image quality, label format, language, and other factors.
You should not rely solely on SugarSpoon for dietary decisions, medical conditions (such as diabetes management), or any health-related purpose where inaccurate information could cause harm. Always verify nutritional information from the original product label and consult a healthcare professional for dietary guidance.
Intellectual Property
The App, including its design, code, graphics, animations, and content, is the property of Melvin P Mathew and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
Limitation of Liability
To the maximum extent permitted by law, Melvin P Mathew shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, damages for inaccurate scan results, dietary decisions made based on the App's output, loss of data, or service interruptions.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for SugarSpoon Pro in the 12 months preceding the claim, or $50, whichever is greater.
Indemnification
You agree to indemnify and hold harmless Melvin P Mathew from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.
Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including limitations of liability, indemnification, and intellectual property) shall survive.
Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the App or via other reasonable means. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the App shall be resolved in the courts of competent jurisdiction.
